WritersWeekly.com has received a complaint about:
Tove Warmerdam / Seattle Dog Magazine / seattledogmagazine.com /
Queen Dog Publishing
WritersWeekly.com is a publication that publishes information for
and about freelance writers. The publication is the
largest-circulation freelance writing ezine in the world.
As part of that information, WritersWeekly.com publishes a Warnings
section on its website and in its newsletter. This warning section
contains reports about publications that are unprofessional in
dealing with writers, haven't paid writers money that is owed to
them, who have not abided by their contracts, or who have unfair
contract terms. These reports are used by WritersWeekly.com's
subscribers
to decide which publications they should and should not work with.
Your firm has been submitted to us for inclusion in the
WritersWeekly.com Whispers and Warnings section.
Step one of our investigation of this report is to gather all
relevant correspondence between your publication and the person
submitting the complaint so that we can piece together that person's
side of the story. Step one of our investigation has been completed.
-------------
THE COMPLAINT
-------------
(CR) (name not published here but was, of course, provided to the publisher) alleges you owe her $7192.00, that you owe other employees
money as well, and that you're seeking investors online but you're
planning to file bankruptcy. See complete allegation under my signature.
-----------------
WHAT HAPPENS NEXT
-----------------
The second step in our investigation is to send this communication
to your firm to get its side of the story. If you have evidence
disputing these allegations, or would like to make your own
statement about these allegations for publication in our report, please
email
angela@writersweekly.com within two business days.
***All correspondence for our investigations must be in writing and
is subject to publication.***
If you do owe this person money, we strongly suggest you read
this article before responding:
http://www.writersweekly.com/the_latest ... 32006.html
Our report on your firm is scheduled for inclusion in our
publication next Wednesday, though it may appear in our Whispers and
Warnings forum before that time.
If there is no response to these allegations, WritersWeekly.com will
still publish this complaint, but our readers will not be able to
read your side of the story.
We appreciate your prompt response in this matter.

Hello, Angela
A writer whom I have worked with in the past said that I should
contact you regarding my situation. I started working for the publisher
of Seattle Dog magazine, Tove Warmerdam, (full-time) as the
editor-in-chief of a new, national dog magazine she was starting. She
paid me my first two paychecks, but when July 15th came around, no
paycheck came.
It's a long story, but she kept lying to me about the check being lost
in the mail, etc., etc. In the meantime I left for a week's
scheduled/paid vacation. While gone, she was supposed to direct deposit
my pay into my checking account. Halfway through my vacation, I checked
my account to find that she had not done so. I contacted her and she
said that she would Fed Ex my check to arrive at my house by the time I
got home from vacation.
I got home on the 27th, and on the 28th, her business partner called to
tell me that she had had trouble with her investors and was backing off
of the new magazine idea. He assured me that she would pay me for the
entire month of July, so two paychecks, plus reimburse me for phone
expenses and medical benefits I never received, plus one month's
severance, as I had turned down many other projects to take hers on.
I got this all in writing from her, and she was first supposed to pay me
by August 4, then it got bumped to Aug 15, then she sent a letter
saying she would pay within 15 days of Aug 15. That hasn't happened. I
found out that she has filed for personal bankruptcy and her bankruptcy
hearing is on Sept. 15. I also found out that she has a posting on
GoBig touting her incredible publishing empire and looking for 5
million in investment money. She owes me and a few of her other
employees thousands of dollars.
Thanks for your time.

Angela,
I've attached the letter I sent to her that spells out
what she owes me. It was a letter that my lawyer drafted
to accept the amount she told me she would pay me. I have her letter in
hard copy only.
Her name is Tove Warmerdam. The two address I have for her are: PO Box
51, Snoqualmie, WA 98065; 8532 381st Place SE, Snoqualmie, WA 98065.
Her e-mail address is
tove@seattledogmagazine.com.
I do have an employment contract signed by both of us that specifically
spells out what I was to be paid and when.
Best,
CR

Dear Tove,
I received your letter of August 1, 2008 and reviewed it with my lawyer
Gerald Nabours. Although your offer of payment is less the agreed-upon
one month's severance, I have decided to accept your offer of payment of
two regular pay periods (gross total $6666.67) and a payment of $426.15
for back pay of medical benefits and $100.00 for telephone allowance
compensation, to be paid no later than August 15, 2008. (The total gross
payment is $7,192.00.)
I will accept the above payment as complete fulfillment of my employment
contract if I receive a valid check by August 15, 2008. If I do not
receive the above-mentioned (exact) amount by August 15, or if I receive
the check and the account does not have sufficient funds, I will file a
formal complaint with the Director of the Washington Labor and
Industries Department. My lawyer has been in touch with this department
and has learned that besides facing monetary penalties, an employer who
fails to pay employee wages has committed a misdemeanor crime. My
lawyer has reviewed all of my documentation and affirmed that I have
more than sufficient evidence to show that you have failed to act
lawfully according to our contract and that I am owed no less than this
agreed payment.
I look forward to receiving this payment no later than August 15, 2008.
Sincerely,
[CR]

Dear Angela,
I have forwarded all the info to my attorney and would love to answer the
questions but awaiting on him to look at this email. I do not know [PR]
and if people are making false statements that will make this all
the more interesting. And as for bankruptcy - my personal finances are of
no one's business. The company has NOT filed for bankruptcy. And invading
in my personal business. So yes, my attorney will advise me on responding,
and otherwise respond to this whole incident.
[b]WRITERSWEEKLY RESPONDS
Per my previous note:
As you probably figured out, the person claiming you owe money is
[CR], not [PR]. I apologized for my error.
There have been no false claims against you. You owe CR $7192 and you're
refusing to answer questions about that to the media (WritersWeekly).
Your personal finances are of interest to people who might consider
working for you. If you're in financial trouble, one must assume your
business is also in trouble. Otherwise, the business would be supporting
you. If you are filing personal bankruptcy in order to not pay people
like CR, that means your business and personal finances
are co-mingled.
Bankruptcy filings are public record. The fact that you answered my
question in such a way seems to confirm the allegations.
Please send me the name of your attorney. We're starting to think you
don't have one.

Hi Tove,
Ah, if I had a nickel for every deadbeat who thought they could silence
the media with a lawsuit threat... You see, it is [CR]'s
constitutional right to tell people about her experience with you
company. Courts sure don't like it when deadbeats try to trample on the
constitutional rights of honest, bill-paying people.
I'm still waiting for your attorney's contact information. Throwing out
a lawsuit threat on your own further implies you don't have counsel.
Here's what we know. CR says you owe her $7192. You have not
denied that claim. We're going to publish CR's allegations, with
or without your comments for publication. If you don't want our readers
to hear your side of the story, that's your business. We'll simply tell
them you refused to comment. We will not wait days, weeks or months for
your phantom attorney to respond. We'll be publishing the allegations
next Wednesday. Please get your response for publication to me by close
of business Monday.
Please remember that, per my initial contact, all correspondence is
subject to publication, including all the emails you've sent to me over
the past few days. I can tell you that your actions so far imply you
have no intention of paying this debt...and that you don't even have an
attorney. If you did, you'd have sent us his/her contact information
after we initially contacted you.
If you'd just admitted you didn't have the money, apologized, and said
you'd work on it, you'd look much better than the picture you've painted
of yourself this week.
When can CR expect payment of the $7192 you owe her?
