ALLEGATION

Hi Angela,

The article I wrote was for a relatively new publication called Rise Up
Magazine. I submitted two articles to the magazine. When I
didn't hear anything for two months, I simply assumed they weren't
interested.

Meanwhile, I kept getting spammed to submit new material and check out
their magazine. I finally wrote to the associate editor and told him
that since it was
fairly obvious that my writing voice was one they were not interested
in, that I would really appreciate not getting spammed with submission
requests.

The associate editor then informed me that they indeed did like my work,
and were going to publish an article I wrote called PUTTING THE AMERICAN
IN AFRICAN AMERICAN.

Gee, maybe I missed the memo….

I was shocked--no one told me that it was slated of publication. I
then asked him if writers were */paid upon publication/* or */paid upon
acceptance./*

He told me that they were */_paid on acceptance_/* and I should be
receiving a check no later than 15 days after they received my invoice.
I sent the invoice off that day...

And I have yet to be paid.

The discussion began June 25th. Repeated calls and emails to their
financial officer, Veronica Tinsley go unanswered...

I am contacting you in regards to a complaint received by one of our
freelance writers, [AN]. RiseUp Publications is a start-up
company that officially launched June 22, 2008. As is the case with
most start-up organizations, we have experienced some challenges in a
few areas in which we have become backlogged. One of those areas is
payables. The writer’s contract states the following payment terms:

“Payments. The PUBLISHER agrees to pay the AUTHOR the agreed-upon FEE
___ per word. The fee is payable fifteen (15) business days after
submission to and acceptance by the PUBLISHER of the WORK for
publication. The AUTHOR agrees to make requested changes to the copy per
the PUBLISHER, including any rewriting, editing or data corrections per
the publication deadlines with no additional compensation.”

The invoice in question submitted by [AN] to RiseUp Publications
is dated July 17, 2008. Payment was due to be made to [AN] within
15 business days (August 7, 2008) resulting in an overdue status by
eleven business days. Payment in full of $331.80 has been issued.

The delay in payment is in no way a reflection of our appreciation for
her contribution. We very much value [AN]’s work and look forward
to continuing and strengthening our relationship as we ramp up our
circulation in the marketplace.

I spoke with Janice Ellis briefly on the phone and while she was very
nice and conciliatory, I felt she thought I was making a big deal over
nothing.

Her exact words were that she had never had another problem with other
freelancers and they work with hundreds of them. She also felt it was
unfortunate that I felt the need to file a complaint with you guys.

My issue with that is, in business, you are bound to run into snags --
dealing with concerns in a timely manner is not only fair, it helps to
keep individuals from feeling as if they are being put off.

If I had simply received an explanation similar to the one I received
when she finally called, I would have been fine--as it were all I felt
was yanked around.

They say I was officially accepted July 17th -- they say they sent the
checks on the 7th -- that isn't 15 days...not to mention I wouldn't even
know I was being published if I hadn't reached out to Dominick Hadley

Now, when I spoke with Janice she said the check was overnighted ( nice
to know) and thankfully, I did receive it today ...

It is what, August 26?

Even by their own time line that is more than eleven days of
inconvenience....

I explained to her that I am a reasonable person, and if someone had
called and said that they were backlogged I would have understood.

She told me they were very busy -- fine, but really, it is
inexcusable--part of running a business effectively is handling issues
-- if Veronica couldn't call me herself they could send word via a
Secretary--hell the copy boy--whoever...

I know I won't feel comfortable rewriting anything for them again nor
will I refer other writers to them....

Great work re: Rise Up. I think you will find there are many in this
unfortunate situation. I wrote 2 stories for Rise Up and am owed $900.
They have yet to be published, but were accepted and invoices issued.
Their writers contract specifically stated payment issued 15 days
after acceptance. My invoices are dated 7/22 and 8/26.

Hi Angela - I, too, have been waiting for a check from RiseUp
publications for several months. I wrote two articles for them and
submitted invoices on July 7 and August 11 totaling $1457.40 but have
not been paid. I was in contact with an editor and was being patient
because I knew they were on a (supposedly) brief hiatus, but when I read
your whispers and warnings column last Wednesday, I immediately sent an
email to the editor I was working with, Jake Singleton. When I didn't
hear from him I sent an email the next day to Domnick Hadley and the day
after that to Veronica Tinsley. I have not heard from any of the three.

I am contacting you in regards to a complaint received by one of our
freelance writers [KB].

After completing our research we found there were no invoices on file
for [KB]. Because we did not have record of owing payment to [KB], she was not included on any of the communications that were
sent to our writers regarding payment status (these communications were
emailed on August 25, 2008, September 16, 2008 and September 23, 2008).

I have since been in contact with [KB] and have asked her to
forward her outstanding invoices to us (of which I have received). She
has also been made aware that we have been awaiting an infusion of
capital from our investor partners and that the delay has created a
backlog resulting in a delay in honoring the debt. In an effort to
show our understanding and appreciation, we offered [KB] a 2-5%
interest incentive in addition to the total outstanding debt owed. Once
the capital is received we have every intention on satisfying[KB]' debt in full.

I was doing some googling to see if there was a forum or other
discussion about the ridiculous business and payment practices of Rise
Up Magazine and ran across the complaints you received about the
publication. Because they owe me $2,000 and have for months at this
point, I too, wanted to send in a complaint to WritersWeekly.

They have made a number of promises to make payment by certain dates;
and all of them have passed without my having seen a dollar. I will
forward you all correspondence about this matter so you can have a clear
idea of what has occurred. Mind you, the overdue payment is for a series
of stories they assigned me after they accepted and published an
article I wrote on the use of the word "Articulate" in reference to
African Americans. Please let me know if you have any questions in
regards to the forwarded messages.

I am desperately trying to get Rise Up Magazine to pay me the $1150.00
they owe me for an article and photos. They paid
me for the first two pieces I did for them but now nothing. I rec'd a
number of emails detailing how important freelancers are to them, their
rounds with financial backers, etc and now I receive no responses to my
emails. I did the work for them in August of 08. I proposed that they at
least pay 50% of the invoice but have not received a response. I would
appreciate any help or suggestions you could offer. all the best,

UPDATE: The publisher claims she has sent out partial payments to all writers who were owed money (far more, it seems, than the 11 who have submitted complaints to WritersWeekly.com).

Many writers have, indeed, reported receiving checks and none have reported that any have bounced.

Thousands of dollars are still owed to many writers. The publisher claimed in an email to one writer on 11/22/08: "We are working to pay everyone in full in December."

Hi Angela – A friend forwarded me the link to the complaints on your
site about RiseUp. I wrote an article for them, approved and accepted by
Jake Singleton, including editing the article to their satisfaction, and
they have yet to pay me. It was a 1,500-word article that I turned in on
July 18 and the payment was 75 cents a word. I had negotiated a higher
rate than the 60 cents they originally offered.

I have been trying to reach Jake Singleton for the past couple of
months, with no response. I left him a voice message as well. Again,
with no response. Their lack of professionalism stuns me. Well, I should
say that it did, until I read your forum posts.

They owe me $1,125. The final changes in the article were turned in on
August 27. I haven’t gotten a response from Jake Singleton since Sept.
5, despite numerous emails and one phone call.

I have attached a word doc of the chain of emails between Jake Singleton
and myself.

I just received the invoice from [T]. I responded to her to let her
know that it was not among the list of writers that was given to me.
Jake Singleton is no longer with RiseUp and hasn't been since early
September.
I also advised [T] that I was sending a payment to her today.
