about freelance writers. The publication is the largest-circulation
freelance writing ezine in the world.

section on its website and in its newsletter. This warning section
contains reports about publications that are unprofessional in dealing
with writers, have refused to pay writers money owed to them, who have
not abided by their contracts, or who have unfair contract terms. These

Hi Angela,

I was contracted to write a piece for MD News Utah by publisher Travis
Barrington in June 2006 in a written contract. In that contract, Travis
promised to pay me $0.35 a word for an article that was later agreed
would be a total of 1,200 words (via e-mail). I submitted my text via
e-mail on time and to length.

My feature article appeared in the first issue of MD News Utah, which
came out in August 06. I have not yet been paid the $420 for my work
despite the fact that the contract stipulated payment on publication.

I have contracted Travis Barrington numerous times about payment, and
when he replies (a rare occasion) he claims that either he can't pay me
right now, but will in the future, or that payment is on the way. I have also
contracted Travis' employer, Sunshine Media, who is currently working
with him as an independent contractor. They claim no responsibility for
Travis' failure to pay me and continue to work with him to date.

I've attached e-mails and the contract to give you additional details.

This COPYRIGHT LICENSE AND RELEASE is entered into on the date indicated
below by and between the
undersigned photographer/author ("Author") and Travis Barrington
("Publisher"), in and on behalf of M.D. News
Utah and in consideration of the mutual covenants herein contained, for
good and valuable consideration, the
receipt and sufficiency of which are hereby acknowledged, Author agrees as
follows:
1. Author agrees to write, photograph, draw, create or design for
Publisher and provide Publisher with
photographs, written materials, electronic materials and/or the like
related thereto ("Works"). Author agrees to
provide Publisher with all negatives, originals, and/or any other
materials or storage media to fully enable
Publisher to reproduce or re-transmit the Works in accordance with the
Purpose.
2. As consideration for the license granted herein to Author´s rights in
the Works and the other obligations and
representations of Author set forth herein, Publisher agrees to pay Author
the sum of $00.35 cents per word.
3. Author hereby grants to Publisher and Publisher´s contractor, Sunshine
Media, Inc. ("Sunshine Media"), a nonexclusive,
worldwide license, including unlimited usage of the Works for the purpose
of preparing, reproducing,
displaying, and distributing printed and digital copies of the stated
Publisher´s magazine, reprints, website
content, and for use in printed and digital copies of Sunshine Media,
Inc.´s and its affiliated brands´ marketing
campaigns and collateral (the "Purpose"). The Works will not appear in
magazines other than the following
Publisher´s stated edition(s) without permission from the Author:
August 2006 M.D. News Utah
4. Publisher and/or Sunshine Media may alter, reproduce, adapt, or
transform the Works in any way so that the
Works are "publication-ready" without obtaining prior written approval of
Author. Such permitted modifications
include, but are not limited to, copyediting, grammar-checking,
spell-checking, edit-to-fit, and photographic
changes and cropping intended to enhance the Works prior to publishing the
Works in printed or digital form.
Publisher and Sunshine Media agree to include a designation adjacent all
copies of the Works acknowledging
Author´s rights in the Works: "© [AUTHOR][DATE]. Used with permission." or
similar wording; in the case of
textual articles, appropriate identification or attribution will be
included as a byline at the beginning of the
article, or as author attribution and/or affiliation at the end of the
article at the discretion of Sunshine Media.
5. Except as necessary for Publisher and/or Sunshine Media to fulfill the
Purpose, the rights set forth in this
Agreement shall not be transferred, sub-licensed or assigned without the
prior written consent of Author.
6. Author also hereby agrees to indemnify, defend, and hold harmless
Publisher and Sunshine Media from any
and all claims and demands arising out of or in connection with the use of
the Works, including, but not limited
to, any and all claims for third party infringement, libel, slander,
misappropriation or any other third party claims
related to or arising out of the Works.
7. Author represents and warrants that all Works provided to Publisher
were created by (or properly and legally
acquired by) Author and Author has not violated any proprietary or
intellectual property rights of any third
parties. If requested, Author agrees to obtain, or assist Publisher to
obtain, an executed release from any of
the subjects in any of the Works created by Author.

Angela,

In reference to the complaint reported by LB, full payment
will be mailed by March 5, 2007. As I've explained to Lucy, it is a cash flow
issue that I admit has taken too long to resolve. I have good
relationships with my editorial contributors with this exception and I sincerely regret
that the incident has escalated to this level.

All relationships and contracts that I enter into are completely
independent of Sunshine Media. Due to the independent contractor nature of my
business relationship with Sunshine Media, they have no right or obligation to
resolve this issue. Please continue to address all correspondence to me
directly.

Hi Angela,

I have just come across a complaint about Travis Barrington of MD News not
paying one of his writers (email
sent Feb. 8, 2007 http://forums.writersweekly.com/viewtopic.php?t=7174 ). I was also contracted to write for that first issue and, fortunately, I was paid for it.

I continued to write over half a dozen feature articles for Travis
Barrington and MD News and have worked
harder to collect the money than I ever did writing the stories.

My last article, written five months ago (January 2007), has not been paid
for by Mr. Barrington despite
numerous attempts. He does not return phone calls or email. Travis
Barrington essentially stole $543 from me
and I'd like it back. Attached are our email correspondences. The last
time I heard from him was April 12th.

I received the check for $500 and copies today, thanks. The
magazine looks great. However, I believe the
check is short by $67.45. I counted the Facial Appearances piece at 1,422
words at 20 cents/word which is
$284.40. The Pain Clinic piece was 1887 words at 15 cents/word which is
$283.05. So together they are
$567.45. I think the discrepancy might be because of the new per-word
rate on the last piece.
The Colon-Rectal piece is coming along well. What is the
deadline/projected word count on this?
