and about freelance writers. The publication is the
largest-circulation freelance writing ezine in the world.

contains reports about publications that are unprofessional in
dealing with writers, haven't paid writers money that is owed to
them, who have not abided by their contracts, or who have unfair

Good evening Angela,

I was introduced to your site by several colleagues back during the
fall. While I never thought I would be writing you for help (of course
no one ever does), I do fear that I am in a position that warrants it..
It involves a client that I have worked with for over a year. Back in
May he contracted with me to write a small manuscript based largely in
part off of his sermons and other personal recordings. Because he was a
good client, and a friend, I agreed to turn his recordings into a book
for a paltry $2500. He agreed and paid the kill fee/down payment of
$1000 in mid-May.

Initially, I agreed to have a first draft ready for him August 15. Due
to the amount of editing and other issues both related to his book and
to me personally and professionally, I fell behind. He was made aware of
this within a week of the due date, and did not indicate a desire to
end the relationship. During the first week of December I let him know
that I was fast finishing up his draft and the first round of editing
and would be forwarding the document. He responded affirmatively. I
delivered his manuscript January 1, and invoiced him via Paypal for the
next installment payment, $750. He emailed that he would be calling
January 9 to discuss the book and detail any changes. I contacted him on
the 9th to remind him via email and text. At that point he stopped
replying to my emails.

I invoiced for the last installment payment ($750) yesterday. I have
received no communication from him in over three weeks, and no response
to my two paypal invoices. At this point he
is avoiding me, my invoices, and I fear he is moving forward with
publishing and selling his book -- that I have yet to transfer the
rights to.

As I have not received any further correspondence from you, nor any
acknowledgment of my previous emails, I am inferring that you no longer
wish to continue our working relationship. Further, I must also assume
that you have, not now or ever, any intention of honoring our contract
for a manuscript, dated May 2010. Without any correspondence from you,
I have no choice but to declare you in default of our contract, and to
seek remedy and payment.

I have composed a letter of submission detailing this issue and
including our correspondences of the past several months. Should
payment in full of our contract not be rendered by February 1, 2011, I
will be submitting these documents, complete with all contact
information necessary to report you and your affiliated
sites/organizations/businesses to the following persons and/or
organizations:

1. This book was agreed to be finish by August 15th I emailed her on 8/21/2010 and
She said my book would be ready and on the shelf by November I never receive book nor transcript and in her email sited several personal reason for not finishing the book……and her statement was “From your tone you either do not remember, or do not believe in this, and that lack of confidence prevents a smooth-running working relationship. 2nd statement was I am currently waiting on another round of transcriptions to come back. When they do (and they are expected from overseas next week), then I will continue the work. And when I mention the agreement she stated you are going to hold me the the due date…well yes. she fell behind. And thought I should end the relation and she keep my $1000.00. The project was abandon my the FREELANCE….I believe I should be entitled to a refund….there is no addition payment due to this freelance be she didn’t product and what she sent 5month later without any addition communication wasn’t based on the 25 transcribed cd’s. There should be a sign saying BEWARE OF THIS FREELANCER……

did not or will not execute a legal written contract with this person
and if you have any information that is contrary to that please produce

As you know, a contract discussed by email is considered a legally
binding agreement in a court of law. No signature is required. Copies of
emails submitted to us by the writer clearly indicate you ordered this
work and that you exchanged copies of the contract with the writer. You
even paid the downpayment that was part of the contract so trying to
claim you're not obligated to honor the contract simply because there is
no signature is not going to work.

When can (DT) expect payment for the work she performed

At this point I've reached the conclusion that you are working on the
behalf of (DT) and not my interest and I believe that we
have reach a point of not resolving or being able to resolve this
matter..As you stated that this contract between johnny chase ,
johnnyandnadine.com and Spirit of Victory Ministries (Not sure which one
has the contract or knot) and (DT) is a valid contract.
although you did state/indicate that it would be valid in the court of
law. That would be my recommendation. This way I will have legal
representation that is working on my behalf just like you are work on
her's...If she needs any information from me that is need to file a lawsuit
I will be more than happy to provide with in reason..At which time I
will file a counter suit for the $1000.00 I gave her for not working
with in the frame of out virbal contract, which I have emails to back
this up....thank you for your time and effort in trying to resolve this
situation that has torn a relationship that was very good with the
exception of this PROJECT.....

Hi Johnny,

I am not on anybody's "side" but it seems clear from the correspondence
below that:
1. You ordered the work and accepted the contract terms
2. You knew the work would be late but did not contest that
3. The contract terms were still valid even if the delivery dates
changed (it clearly states in the contract that the delivery dates could
change)
4. You never asked the writer to stop work on the project, even when you
knew the delivery date would be changing
5. You received the finished product

You ordered the work. The work was completed. Payment is now due. Those
are the facts.

I already provided a copy of the contract to you. It's in the
correspondence we've been exchanging below. I'll paste it once again
directly under my signature. Again, the lack of a physical signature
does not mean the contract is not or was not in force.
Email agreements are recognized and accepted by the courts. You clearly
agreed to the terms and ordered the work, even paying the downpayment
required by the contract. Trying the old "I didn't sign the contract so
I don't owe you anything" excuse isn't going to work if she sues you.
Again, email agreements are considered binding.
