ALLEGATION

Hi Angela,

My name is (TL). I need your help. Shannon Ferguson hired
me to do some work for her and everything went down south. She
posted the job on Odesk.com I applied for it, she wanted to interview
with me and I did. She stated that Odesk would not let her hire so
many workers and asked me if we could do it on our own, I agreed. I
looked her up and she had a little business so I thought well ok she
is legit. Her website is www.wordsbykeystroke.com. The project that
I was working on for her was to find 100 resumes on Craigslist that
matched a certain criteria. (For) this project she was paying me 75.00. I
got almost half way through and she told me to stop; that her client
had changed their mind and we had to start all over. I stated that
was fine. She said we will talk on yahoo messenger about the whole
situation I waited and waited, she finally came online and we
discussed the second job. This one consisted of reformatting resumes
and finding the proper content with the resumes on Craigslist. (For) this
one she was going to pay me 1.00 for each one and she gave me 100.00
to do. She also asked me if I knew of anyone that wanted to help as
there we a big chunk that needed to be done for the next three days.
I went to my workplaceathome forum and recruited at least 20 people.
I asked her about my pay for the first job and she stated oh yes I
will pay you tomorrow by paypal. I said ok, that is fine. Well I got
started with the second round and low and behold she told me to stop
once again. I said why is that she said they are not being done
correctly, you are changing the outline, and I told you that is not
what was supposed to be done. I said I am doing them correctly why
do you keep stopping me when i get started? It is like you are not
wanting to pay me or something. It honestly blew up from there. Some
very bad things were said. I continually asked her via yahoo
messenger and via email about my pay. She stated yes, I am going to
pay you at the end of the day. Well it has been going on two weeks
and nothing. She is ignoring all my messages. It is not a lot of
money but with these tough times it is enough to pay at least one
bill. Could you help me or lead me in the right direction as to what
I am supposed to do to get my money? I do have all copies of all
emails and messages from the start to finish. Thanks for listening

Dear Ms. Hoy,

Thank you for contacting my company about this complaint and I will
happily work with you to expedite closure to this issue.

Before issuing the said "Resume" project to (TL) I expressed the
guidelines several times to make sure she understood how the work should
be completed and returned. There were strict guidelines for this
project, per my client's request. (TL) said that she understood the
requirements and accepted the terms.

1. My client had an HTML template specially developed by web programmers
that included CSS styles (fonts, table settings, etc.) Each resume had
to use the same template without any changes.
2. I explained to (TL) not to change any of the fonts or table
settings within the template because the client would not accept the work.
3. (TL) changed the fonts and structure of the format resulting in
work that was unacceptable.
4. I pointed this out to her and her first response was "Do you know
that I stayed up all night working on this...just pay me my money."

I explained that she changed the format and structure of the template
which was expressly prohibited. She said "it looked fine to her."

(TL)'s attention to details were careless and I can forward some of
the emails containing the work she turned in. Resumes are not meant to
have all the content centered (meaning all text formatted in the middle
of the page).

And please note, while she does have some positive feedback on "Odesk",
there is also negative feedback that mentions the same issues I have
had...problems with details.

She knew there was no "kill fee" for this project and that payment was
upon successful delivery of items per the guidelines that she accepted.

And I might add that (TL) did not submit that many resumes, so I'm
unsure of where she is getting her figures from? She takes no pride in
her work; is careless and doesn't try to make the client happy when work
is sub-standard.

I am always available for further discussions and I do have archives of
all discussions between myself and (TL) in addition to her emails
with attachments.

Hi Shannon,

Below is the writer's rebuttal. We do have proof that you promised to send payment yet you never did. Your claims now about poor quality, after promising to send payment, don't make any sense and this is a common tactic we see from deadbeats who owe freelancers money.

When can (TL) expect payment in full of the funds you promised when hiring her for this work? Is all of this really worth the paltry amount of $180 and the obvious bad publicity that will result from this?

Wow, First off all of what she just claimed is false. As you have copies
of the conversation between me and Shannon. She never stated that I
would be paid per once the project was complete. AS for the Odesk
feedback I have attached my profile with my feedback scores. I received
one low for when I was in the hospital with pneumonia. Which does that
really matter me defending myself with my Odesk score as she still hired
me with her looking at my profile. When she told me to STOP for the
second time, mind you the first time she blamed it on the other girl
that was doing the project ( I still get the blame for this even tho I
have proof that she blamed someone else for this) Is when I lost my cool
as any other person working on this would of. First off she interviews
and posts this job on Odesk.com then I trust in her when she ask me to
go outside of Odesk.com and she does mention that in an email basically
haha you didnt go thru Odesk. I will forward that to you as well in
another email. Bottom line is I worked for Shannon Ferguson, she admitted
several times that she was going to send me payment and she has not.
There are laws that require payment for my services and I will not
hestitate to seek further action. Thanks (TL)

WRITERSWEEKLY HAS RETAINED COPIES OF THE CORRESPONDENCE SENT IN AND WILL NOT PUBLISH IT. HOWEVER, WE WILL SHARE THIS:

On October 21st, Shannon Ferguson told TL, that they were "all fine" and that she was just fine tuning formatting.

She also says she has more work available for right now but that she can only pay via Paypal. She then asks if TL can be paid via Paypal.

On October 22nd, she wrote that she told TL yesterday that she would be paid for the previous ones before she stopped work and that she could pay via PayPal. She then adds that the next ones will be paid on Monday.

She also states at one point there were only a couple of errors. Later, the argument gets heated and all kinds of accusations fly, including about quality issues.

Additionally, she cut and pasted some of the conversations, not all of it. How can you make an educated decision and print anything when a person doesn't send you the entire transcript?

This is why my lawyer is scrutinizing everything that has been said, including the email where you give her *hugs*. This seems one sided and not at all like someone providing an independant review.

Hi Shannon,

The fact that you stopped work mid-way through the projects is not the
writer's fault and you can't dock her pay because of it. She refused
another job to work for you and you then reneged on your contract.

Here's another thing that doesn't make any sense. You're going to end up
owing your attorney far more than the $180 you owe the writer for the
two projects you assigned to her.

These are the facts:

1. You assigned a project to her and promised payment

2. She worked for you but you killed the project (through no fault of her
own). You owe her the promised amount for that project.

3. You liked her work so much that you assigned another project to her.
You killed that project as well. You also owe her for that project.

4. You then promised payment to the writer...but never paid her.

5. We contacted you and you then blamed the quality of her work when the
conversations clearly prove that isn't the case.

We also start out with our eyes wide open in an investigation. However,
the amount of proof provided here is indisputable. If her work was so
bad, why did you hire her for a second project? If you never intended to
pay her, why did you promise to send payment?

If you look at the transcript, even she says "ok, I did...28 and 20 that's 48 total so just pay me for those..."

She did them wrong which I pointed out and she would not revise.

Again, only parts of the transcript have been sent to you and I plan on following up with legal action.

I do not know you and as far as I know you are not (TL)'s attorney so when she receives notice from a Federal court I suppose she can forward to you if she wants.

Ang,
If you look at the emails Shannon states that " I only said a couple was
done wrong." That come from Shannon not me. And now she is saying that I
did all of them wrong. And for the slander, it is not slander when you
are stating the facts. I went to my work at home forum which that is
where i recruited alot of people to help us on these projects and told
them to beware she did not pay. This is a true statement. So I welcome
the slander lawsuit as it will not go anywhere but with a counter claim.

Shannon keeps stating that I did not send all of my emails or messages
to you and this is false as well. You have the yahoo messages where she
states that she owed me money and that she would pay me on that Sunday.
I admitted that I was wrong for blowing up like i did with her stopping
two assignments. I thought I was being the bigger person but apparently
not. Once again here is all the chat from 10/22/2009. The bottom line
is I provided my services did not get paid for it and I am entitled to
my earnings. We can go back and forth about who is right and who is
wrong all day long and not solve anything. I was hired on for the first
project for 75.00 and the second one for 105.00. I did complete 28 of
the first and 20 of the second. I do have all my resumes saved as I can
send individually if needed. It is not my fault that Shannon stated that
the other girl she hired off Odesk messed the first project up and that
is why her client was changing how we do it. You will find below the
statement Shannon made regarding the other girl. Thanks (TL)

RJ provided WritersWeekly with copies of email sent to her by Shannon Ferguson who claimed there was a family emergency, but who also promised payment would be made. RJ reports it never arrived and that her emails are being ignored.
