 Post subject: my daughter needs help

My daughter's husband has is trying to kick her and her kids out of the house. She would like to go home to her parents house but it is out of state. Can the husband prevent her from taking the children out of state. She has not yet been served with any court orders.

It depends on the laws of the particular state, but absent any orders to the contrary it is most probable that she would be okay moving away. The best advice, however, would be for her to consult a divorce attorney. A simple consultation like this won't cost that much and could save a LOT of trouble later on.

She can also contact her local shelter as they'll probably know what she should do / who she should call in her particular case. Even if she's not planning to utilize he shelter, they have info. on all the local support services.

She should try to obtain his request for her to leave in writing, so he later can't claim she kidnapped the children an ran. Even an email from him would be better than just a verbal request.
